What Is an Office Action?
A USPTO Office Action is an official letter from the United States Patent and Trademark Office. It will raise issues with your trademark application. These issues might be minor or more substantive.
However, they fall into two categories:
- Non-substantive issues like technical corrections
- Substantive refusals, such as legal reasons the mark may not be approved
This means your application is not moving forward. However, it also means you have a chance to respond and fix the problem.
Why You Might Receive an Office Action
Office Actions are common. And this can happen for well-prepared applications. Some of the most frequent reasons include:
- Likelihood of confusion with an existing trademark
- Descriptive or generic wording in the mark
- Issues with how goods or services are described
- Problems with the specimen for proof of use in commerce
- Incorrect filing information
- Missing disclaimers for certain terms

Wait for the Examiner’s Review
After you submit your response, the application goes back to the examining attorney.
At this stage, one of three things will happen:

- A final Office Action is issued
- The application is approved for publication

If a final Office Action is issued, you may still have options, such as filing an appeal or a request for reconsideration.
Publication If You Succeed
If your response is successful, your trademark will be approved for publication in the USPTO Official Gazette.
This opens a 30-day window where third parties can oppose your mark if they believe it conflicts with theirs. If no one objects, your trademark moves one step closer to registration.
